Ignore the subject line, I think we all know the answer to that  :whistle:

I bought a cable through a suppliers website and paid using Paypal, the total value including delivery was £11.90. A week went by and the tracking no. (Evri) showed it was out for delivery two days before, this remained unchanged for another few days. I emailed the seller, he was so disinterested he was almost rude. When I pressed the fact that the Evri status hadn't changed for a week he eventually said that I had agreed to his terms of business when I purchased from him and they say that he doesn't have to do a thing for fourteen days.

Meanwhile I had raised a case through PayPal. Yesterday two things happened 1. PayPal found in my favour and refunded £11.90  2. Evri delivered the cable  lol  This is where it gets childish...

I receive this from the seller;

Hi Andy
The Evri tracking has now been updated to delivered
As we have already refunded you we can offer you 2 solutions
1.   If you wish to retain the cable we can re send a paypal invoice for the value
2.   I you wish to return the item please inform us and we will forward our return address and instructions

This was my reply;

I will give this as much attention and priority as you did.

If you want to arrange a courier to collect your cable, you are welcome to, however, I am now away on business for fourteen days so it will have to be after that.

You're not a child at all, I'd keep the cable and the money to teach the idiots a lesson.

I know its only £11.90 but it's the principal...

Can't believe PayPal agreed that quickly , thought disputes took longer ...  :shrug:

The PayPal dispute was opened in parallel, it took them five days to find in my favour, by that time the Evri tracking was well out of date.

Oh, and there is nooo way I am putting it in a Jiffy bag or driving it to a Post Office. His email implies that he intended just to send me his address and that I should send it back to him  :haha:

I've done a near identical thing, I simply invited the seller to send a courier to pick the item up from my address, which they declined. Call them out I say, bad service deserves to be punished !

I'm sorry to say that although the seller was short to the point of being rude, I still would have given him the fourteen days he requested before contacting PayPal. Having said that, if you had given fourteen days then there would have been no issue and you would have had the cable. Sorry, I think I'm too nice to bad sellers sometimes.

It’s been well documented that Evri have had big problems recently for very late deliveries, so I think the problem lies with them and not the seller, doesn’t give him the right to be rude and maybe he should of said that there has been problems, that’s of course he knew?

I needed the cable, in fact I had to go out and buy one while this debacle was ongoing.

The trouble is, we (I) am spoilt with the likes of Amazon, where nearly everything is next day delivery. The seller could learn from this, if I was them, I would have taken the hit, refunded my customer and taken the failed/late delivery up with the courier.

If the seller had taken that approach and the cable arrived, I would have sent it back without question.

Not so much childish, a bit bearing a grudge perhaps but perfectly understandable, it may not be his fault (evri are crap generally) but he could have dealt with you in a more reasonable manner. Doubt you'll use him again so f#ck him.

10 days later, no Bras... so she's off to Egypt with scraggy Bras ....
On her return ... from a week with her mates in the sun ...
M&S apologise .... and send new Bras....
They arrive the next day .... DPD ...
2 Days later EVERI deliver 3 bras, apologise, and refund the value to Julies account ...
Julie's Bras .. 6 .... EVRI and M&S ..  0

As far as I'm concerned, everyone knows about the postage delays, including sellers and businesses. If they don't change their postage estimates to account for that, more fool them...

I did order something from eBay that wasn't delivered, the tracking just stopped after it reached the sorting station (RM48?). I gave the seller the chance to sort it, and after about a week-10 days extra, they just refunded me. Just under 3 weeks in total for a RM48 package to be delivered!

Next day, it turned up... I did offer to pay them back but they refused (I presume they'll get their money back from RM from a delayed delivery!)

This bloke is really determined to win a poor customer service award. He is sorry the parcel was late/declared lost by the courier, and although he understands that I had to buy one elsewhere, that's not his problem and he expects me to pay the £4 to post it back to him.

He suggested I take legal advice (he actually typed advise  :GRR:)

On the legal side of things I believe that (sale of goods act) the terms of delivery are part of the contract between the seller and buyer.
